Every time a student copies a paragraph from Wikipedia without attribution, or a school installs unlicensed software to cut costs, an ethical boundary is crossed – often without anyone realizing it. As digital tools become central to teaching and learning, the ethical challenges they bring have grown just as fast. Privacy breaches, plagiarism, software piracy – these are no longer fringe concerns. They sit at the heart of how education is delivered today. Understanding these issues, and knowing how to respond to them, is now a core responsibility for every educator and student.

The ethical dilemmas in ICT: privacy, plagiarism, and software piracy

The integration of information and communication technology (ICT) into education has created a set of ethical challenges that go beyond simple rule-breaking. According to research published by Springer, the most common ethical problems teachers encounter when using IT in academic settings include plagiarism, infringement of intellectual property rights, incorrect use of personal data, and unauthorized use of software or multimedia resources. These aren’t isolated incidents – they reflect structural gaps in how digital ethics is taught and understood in educational settings.

Privacy: whose data is it anyway?

With the move to online learning platforms, educational platforms now collect enormous volumes of personal data – names, email addresses, grades, behavioral patterns, and even biometric information in some cases. Students and parents often hand this over without fully understanding how it will be used, stored, or shared. The ethical issue isn’t just data collection – it’s the lack of transparency around it. When a student logs into an LMS, participates in a video class, or submits an assignment online, traces of that activity are recorded and may be accessible to institutions, third-party vendors, or advertisers. How much of this should be permissible, and who decides?

Digital media has significantly blurred the lines of ethical behavior around plagiarism, particularly among students who may not fully understand the consequences of presenting someone else’s work as their own. This includes copying text verbatim, failing to cite sources, or using another person’s ideas without proper acknowledgment. Research has found that a significant number of students believe software piracy is legal, and that students show far less moral concern about software copying than about stealing physical property. The misconception that sharing software for educational purposes is acceptable under “fair use” is also common. However, it is explicitly illegal for a faculty member or student to copy software for distribution among a class without permission from the author or publisher – even when the intention is purely educational. The need for a digital code of ethics

Given the scope of these issues, a structured digital code of ethics for education is not a luxury – it is a necessity. Such a code would establish clear, shared principles for how technology should be used in teaching and learning environments. It would cover how to handle student data, how to cite digital sources properly, what constitutes acceptable use of software, and how to engage respectfully online.

Institutions should develop comprehensive policies covering privacy, accessibility, inclusion, and plagiarism, ideally in consultation with students, teachers, and legal experts. These policies need to be communicated clearly – not buried in terms-of-service documents – and backed by training. Research confirms that implementing internet ethics education in higher institutions is one of the most effective proactive responses to the rising prevalence of unethical online behavior.

What educators can do

Teachers play a foundational role in shaping ethical digital behavior. Educators must demonstrate, guide, and help students practice appropriate and professional behavior while actively participating in authentic digital learning experiences. This means modeling proper citation in their own materials, using only licensed software and tools, and creating classroom cultures where academic honesty is discussed openly – not just enforced punitively. When students see teachers cutting ethical corners, they take note. Ethical leadership in a classroom is as much about modeling as it is about rules.

What students need to understand

Students need more than policy documents – they need practical literacy. This means understanding that even resources freely available on the public web are protected by copyright, and that using them without attribution is a violation of intellectual property rights. It also means knowing the difference between plagiarism (presenting another’s work as your own) and piracy (distributing another’s work without permission) – two distinct violations that are often conflated. Plagiarism is not illegal in a criminal sense, but it is a serious ethical violation that can lead to academic dismissal and other consequences. Students benefit most when these issues are introduced early and revisited regularly, not treated as one-time orientation checkboxes.

Impact on privacy and data security in online learning

The shift to online and hybrid learning during the COVID-19 pandemic exposed just how unprepared many institutions were for the privacy risks of digital education. When schools transitioned rapidly to remote learning, many educators used video conferencing platforms that were not designed for children or K-12 settings, creating gaps in data protection that existing laws hadn’t anticipated.

In the United States, two key federal laws govern student data privacy. The Family Educational Rights and Privacy Act (FERPA) gives parents and eligible students the right to access and control educational records, and requires schools to protect this information from unauthorized disclosure. For younger students, the Children’s Online Privacy Protection Act (COPPA) mandates that websites and apps obtain verifiable parental consent before collecting personal information from children under 13. At the international level, the EU’s General Data Protection Regulation (GDPR) imposes similar requirements on European institutions and any platforms serving EU-based users.

Despite these frameworks, gaps persist. The majority of cloud service contracts used by schools do not adequately address parental notice, consent, or access to student information. Many EdTech vendors operate under terms-of-service agreements that schools lack the legal resources to properly vet. Data breaches in the education sector have illustrated these vulnerabilities – a 2020 incident involving a major online proctoring service exposed the personal data of hundreds of thousands of users, including names, email addresses, and passwords. These incidents are not just technical failures – they represent ethical failures in how institutions choose, implement, and oversee the tools they give to students.

Surveillance and academic integrity tools

One area where data ethics becomes particularly complicated is in the use of plagiarism detection and remote proctoring tools. Platforms like Turnitin and online exam proctors collect detailed behavioral data – keystroke patterns, eye movements, browser activity – to monitor academic integrity. While these tools serve a real purpose, they also raise serious ethical questions about over-surveillance and whether such monitoring is proportionate. The absence of physical oversight in virtual learning environments has led to the adoption of these technological solutions, but they introduce their own ethical complexities around student autonomy and consent.

Balancing innovation with integrity

Technology has undeniably expanded what is possible in education – personalized learning, global collaboration, open access to knowledge. But expanding access to tools does not automatically produce ethical users of those tools. The challenge is to harness the power of technology while ensuring it does not erode the values that make education meaningful: honesty, fairness, and respect for intellectual work.

One productive framework is digital citizenship – the idea that students and educators have rights and responsibilities in digital spaces, just as they do in physical ones. School districts put in place Acceptable Use Policies (AUPs) to ensure appropriate usage of the internet and technology equipment, but these need to be part of a broader culture of ethical learning, not just a compliance document. Teaching students to critically evaluate web sources, properly attribute content, understand copyright and fair use, and recognize privacy risks equips them with skills that extend well beyond the classroom.

Institutions, for their part, need to do more than publish policies. Conducting workshops and webinars on issues like digital consent, copyright, and bias – and reinforcing these through regular communication – helps build the awareness and habits that make ethical use of technology sustainable. Developing programs for educating both students and teachers is the most effective way to prevent and reduce ethical issues in digital environments.

Ultimately, the ethical use of technology in education isn’t about restricting innovation – it’s about directing it responsibly. When educators and students understand what’s at stake – for intellectual property, for personal privacy, for academic trust – they are better equipped to use digital tools in ways that strengthen learning rather than undermine it.
